bodily harm - after the charge was downgraded from attempted murder - to Christopher Steven
Jones, 34, in the Brisbane Supreme Court on Tuesday.

Inescapably, computers will be playing an ever larger role in our lives. But exactly what tasks will they be allowed to perform, and how will we use government regulation to evaluate the risks?
Most of us don't trust computers completely, and for good reason. Our smartphones freeze and our hard drives crash with disconcerting regularity. Yet we frequently place our lives in the hands of computers, which are embedded in our cars, operate airplane navigation systems and even help conduct robot-guided laser surgery.
Inescapably, computers will be playing an ever larger role in our lives. But exactly what tasks will they be allowed to perform, and how will we use government regulation to evaluate the risks associated with new technologies? These questions will be increasingly pressing as innovations strain the longstanding rules that regulate modern life.
Consider one potentially important technology, the driverless car. The idea is simple: a computer drives the car for you, based on input from the surrounding environment. Putting a computer behind the wheel may sound scary, but in road tests performed by Google and other companies, the cars have had a good safety record.
The benefits of driverless cars are potentially significant. The typical American spends an average of roughly 100 hours a year in traffic; imagine using that time in better ways -- by working or just having fun. The irksome burden of commuting might be lessened considerably.
Furthermore, computer-driven cars could allow for tighter packing of vehicles on the road, which would speed traffic times and allow a given road or city to handle more cars. Trips to transport goods might dispense with drivers altogether, and rental cars could routinely pick up customers. And if you worry about the environmental consequences of packing our roads with cars, since we can't do without them entirely, we still can make those we use as efficient -- and as green -- as possible.
The point is not that such cars could be on the road in large numbers tomorrow, but that we ought to give the cars -- and other potential innovations -- a fair shot so that a prototype can become a commercial product someday.
Michael Mandel, an economist with the Progressive Policy Institute, compares government regulation of innovation to the accumulation of pebbles in a stream. At some point too many pebbles block off the water flow, yet no single pebble is to blame for the slowdown. Right now the pebbles are limiting investment in future innovation.
The driverless car is illegal throughout the United States and, while not specifically banned elsewhere, most traffic laws assume that a human being is driving.
Google, which has been at the forefront of this particular technology, is asking the Nevada State Legislature to relax restrictions on the cars so it can test some of them on roads there.
Unfortunately, the very necessity for this lobbying is a sign of our ambivalence toward change. Ideally, politicians should be calling for accelerated safety trials and promising to pass liability caps if the cars meet acceptable standards, whether that be sooner or later. Yet no major public figure has taken up this cause.
Enabling the development of driverless cars will require squadrons of lawyers because of the assumption in the law that a human being is at the wheel. No state has anything close to a functioning system to inspect whether the computers in driverless cars are in good working order, much as we routinely test emissions and brake lights.
Ordinary laws change only if legislators make those revisions a priority. Yet the mundane political issues of the day often appear quite pressing, not to mention politically safer than enabling a new product that is likely to engender controversy.
Politics, of course, is often geared toward preserving the status quo, which is highly visible, familiar in its risks, and lucrative for companies already making a profit from it. Some parts of government do foster innovation, like Darpa, the Defense Advanced Research Projects Agency, which is part of the Defense Department. Darpa helped create the Internet and is supporting the development of the driverless car. It operates largely outside the public eye; the real problems come when its innovations start to enter everyday life and meet political resistance and disturbing media reports.
About 40,000 Americans die each year in car accidents. Would driverless cars reduce this toll? We will need further tests and development to know for sure. But the way things stand now, we may never get the chance to find out.
Consider this thought experiment. Assume that driverless cars could certainly reduce deaths by avoiding accidents caused by people who drive while intoxicated or who simply make stupid driving decisions, like driving on the wrong side of the road. Add in the likelihood that even after they are perfected and well inspected, driverless cars would lead to special problems, perhaps if the computers didn't respond properly to some unusual situations.
To continue this experiment, imagine that the cars would save many lives over all, but lead to some bad accidents when a car malfunctions. The evening news might show a "Terminator" car spinning out of control and killing a child. There could be demands to shut down the cars until just about every problem is solved. The lives saved by the cars would not be as visible as the lives lost, and therefore the law might thwart or delay what could be a very beneficial innovation.
Furthermore, a company with deep pockets might be reluctant to take on the legal liability associated with selling driverless cars and would not invest heavily to improve the technology.
In the meantime, transportation is one area where progress has been slow for decades. We're still flying 747s, a plane designed in the 1960s. Many rail and bus networks have contracted. And traffic congestion is worse than ever. This is probably part of a broader slowdown of technological advances.
But it is clear that in the early part of the 20th century, the original advent of the motor car was not impeded by anything like the current melange of regulations, laws and lawsuits. Potentially major innovations need a path forward, through the current thicket of restrictions.
That debate on this issue is so quiet shows the urgency of doing something now.

Dollar Memo prize, announced in Port Douglas today.
It's the ultimate reward in Tourism Queensland's global push into the lucrative corporate
incentive market.
The prize will be distributed among ADR's employees, including Mr MUSTAM, based on
internal performance reviews.
The company also plans to send an extra 200 employees at its own expense.
Family members and some of the ADR's top customers will also be invited.

Three years after its creation, the Global Network Initiative, whose aim is to protect free speech, has failed to attract corporate members beyond the original three: Yahoo, Microsoft and Google.
When Google, Yahoo and Microsoft signed a code of conduct intended to protect online free speech and privacy in restrictive countries, the debate over censorship by China was raging and Internet companies operating there were under fire for putting profits ahead of principles.
It seemed to be the perfect rallying moment for a core cause, and the companies hoped that other technology firms would follow their lead.
But three years later the effort, known as the Global Network Initiative, has failed to attract any corporate members beyond the original three, raising questions about its potential as a viable force for change.
At the same time, the recent Middle East uprisings have highlighted the crucial role technology can play in the world's most closed societies, which leaders of the initiative say make their efforts even more important.
"Recent events really show that the issues of freedom of expression and privacy are relevant to companies across the board in the technology sector," said Susan Morgan, executive director of the initiative. "Things really seem to be accelerating."
But the global initiative is not. All of the participating companies are American. Also, Facebook and Twitter are notably absent despite their large audience and wide use by activists, in the Middle East and elsewhere.
Bennett Freeman, senior vice president of the mutual fund company Calvert Investments and a board member of the initiative, pointed out that the three current members were among the biggest Internet companies, but he acknowledged that "we are going to have to add some new companies soon to be truly influential."
The biggest test yet for the initiative comes later this year, when member companies will be judged on whether they have adequate policies in place to handle human rights issues. Independent auditors, for example, will examine whether the companies narrowly interpret government demands for user information and whether they store users' data in countries where free speech is protected. They will then issue a report.
Next year, the companies will undergo a more thorough review of whether they have lived up to the code of conduct's principles.
The initiative was created in 2008 after human rights groups and politicians condemned the top Internet companies for complying with China's restrictive laws rather than jeopardizing their business interests by challenging them.
Yahoo had turned over data that led to the imprisonment of several Chinese activists. Microsoft had shut down a blog by a Chinese journalist who worked for The New York Times, which owns the International Herald Tribune. Meanwhile, Google had introduced a censored search engine in China (although Google has since shut down its search engine in China).
The initiative is modeled on previous voluntary efforts aimed at eradicating sweatshops in the apparel industry and stopping corruption in the oil, gas and mining industries. As with those efforts at self-regulation, this one came at a time when Internet companies were seeking to polish their image and potentially ward off legislation.
The code of conduct says that companies must try "to avoid or minimize the impact of government restrictions on freedom of expression" and protect user privacy when demands by government "compromise privacy in a manner inconsistent with internationally recognized laws and standards."
In practice, however, the code offers flexibility. Companies that go along with a country's censorship requirements can remain in compliance as long as they disclose it, as Microsoft does with its search results in China.
A number of participants, which also include human rights groups, academics and firms specializing in socially responsible investing, agree that the initiative started slowly. Much of the focus since its founding has been on getting organized and hiring.
Originally, the membership was supposed to include the entire spectrum of software, hardware and telecommunications firms along with Internet companies. The idea was that a bigger roster would mean greater influence and credibility.
But recruiting efforts have been fruitless. Some companies have cited the auditing process as being too onerous, according to Global Network Initiative participants who spoke on the condition of anonymity because of the sensitive nature of the discussions. Other companies do not see any financial benefit.
Andrew Noyes, a spokesman for Facebook, declined to address why Facebook had not joined. But he said that his company took seriously the issue of user trust and was in regular contact with governments and human rights groups.
"As Facebook grows, we'll continue to expand our outreach and participation," Mr. Noyes said, "but it's important to remember that our global operations are still small, with offices in only a handful of countries."
Twitter declined to comment.
Where the initiative has been most effective so far is in creating a forum for companies to easily get advice and share ideas. For instance, human rights groups contacted Google after it removed videos in 2007 from YouTube showing police abuse in Egypt because of guidelines prohibiting violence. Google ultimately decided to restore the videos and adjust its policy to allow such clips.
Some human rights groups said that the initiative's code of conduct was weaker than they would have liked. Getting companies to sign on would have been impossible otherwise, they acknowledged, describing the code's final version as the best that could be hoped for at the time.
Even with the code of conduct to help guide them, companies will inevitably come across issues that have no easy answers, said Rebecca MacKinnon, a senior fellow at the New America Foundation who specializes in online privacy and is a participant in the initiative.
"Most of these issues aren't black and white," Ms. MacKinnon said. "The idea is to help them do the right thing rather than play 'gotcha' after they mess up."

NSW:Chemical scare at Qantas catering site
SYDNEY, Dec 6 AAP - Eight people have been treated by paramedics and hundreds more
have been evacuated after a chemical scare in southern Sydney.
Fire and ambulance crews were called after a strong odour was detected throughout the
Qantas catering building near Mascot Airport at 7.37am (AEDT) on Monday.
NSW Fire Brigade superintendent Ian Krimmer said the odour was believed to be from
a floor treatment product.
"At this stage it is believed to be a floor treatment product, the vapours of which
have gone through the building as a result of air conditioning," he told reporters.
"We've evacuated up to 400 people from the building as a precaution."
A NSW Ambulance spokesman said eight people were being treated at the scene for fume
inhalation as fire crews ventilated the area.
St George Hospital is on standby to treat patients.

Fed: 25 per cent tax increase on cigarettes from midnightl
The tax on cigarettes will rise by 25 per cent from midnight .. as part of the federal
government's crackdown on smoking.
The government will also force tobacco companies to use plain packaging from July 1, 2012.
A government statement says the changes will cut tobacco consumption by six per cent
and the number of smokers by two or three per cent .. or about 87 thousand Australians.
The 25 per cent tax increase will mean an increase of about two dollars 16 for a pack of 30.
Raising tobacco excise will generate an extra five billion dollars over four years
.. and the money will be directly invested in hospitals.
The government says the new legislation will prohibit logos .. brand imagery .. colours
.. and promotional text .. other than brand and product names in standard colour .. position
.. font style and size.

CANBERRA, Dec 15 AAP - The federal government is pushing ahead with its controversial
plan to filter the internet, saying illegal material can be blocked "with 100 per cent
accuracy and negligible impact on internet speed".
Labor will introduce legislation next year requiring all service providers to ban "refused
classification" material hosted on overseas servers.
Communications Minister Stephen Conroy says RC material includes "child sex abuse content,
bestiality, sexual violence and the detailed instruction of crime and drug use".
"Most Australians acknowledge there is some internet content which is not acceptable
in any civilised society," Senator Conroy told reporters in Melbourne after giving the
mandatory filter the green light.
"It is important that all Australians, particularly young children, are protected from
this material."
The list of banned sites will be maintained by an independent body "at arms length
from the government".
Senator Conroy said the list would be "compiled through a public complaints mechanism",
but the government will add sites containing "known child abuse material" obtained from
"highly regarded international agencies".
Currently, the Australian Communications and Media Authority (ACMA) is responsible
for issuing take-down notices for black-listed content hosted in Australia.
The government released on Tuesday the results of a filtering trial, claiming it proved
blocking sites was technically feasible.
"The live trial has shown that filtering of a defined list of URLs (web addresses)
can be done with 100 per cent accuracy and negligible impact on network performance, despite
the many claims that have been touted," Senator Conroy said.
Critics have argued the filter will slow internet speeds.
They also believe it's an attempt at censorship, and won't stop those hell-bent on
accessing illegal content.
Greens communications spokesman Scott Ludlam says the policy is a dud.
"The test results themselves say the filters will be able to be circumvented," he told ABC Radio.
"So I don't know why the government is persisting with this policy."
Senator Ludlam also suggested the "internet censorship" legislation would have a "bumpy"
ride through the Senate.
Senator Conroy said Labor would introduce its draft laws by March, and the filter would
start 12 months after they were passed.
However, the opposition says it remains concerned the filter will be unworkable and ineffective.
"Appropriate adult supervision and guidance should be front and centre of all online
safety efforts," coalition communications spokesman Tony Smith said in a statement.
"(But) while our reservations about the effectiveness of the (filter) proposal are
strong, we will examine and assess the detail as we have consistently said we would."
Activist group GetUp argues the filter will hand control of the internet "to the moral minority".
"Innocent people, such as a dentist from Queensland, have already been caught in the
ACMA blacklist," acting director Oliver MacColl said.
"The introduction of Senator Conroy's great firewall of Australia may lead to many
more innocent small business people being caught out."
The Australian Christian Lobby and Family First's Steve Fielding welcomed Tuesday's
announcement, arguing a filter would help protect children.
Leading telcos also offered support - albeit qualified.
Telstra said filtering sites was "feasible and practical" so long as the blacklist
was "limited to a defined number of URLs".
Optus similarly stated it was "technically feasible to block a finite list of illegal
content without significant impact on the customer's experience or network performance".

MELBOURNE, Aug 25 AAP - Cats with a fondness for gourmet meals are threatening fish
supplies, an Australian scientist says.
Deakin University scientist Dr Giovanni Turchini has discovered an estimated 2.48 million
tonnes of forage fish - a limited biological resource - is consumed by the global cat
food industry each year.
"That such a large amount of fish is used for the pet food industry is real eye-opener,"
Dr Turchini said.
"What is also interesting is that, in Australia, pet cats are eating an estimated 13.7
kilograms of fish a year which far exceeds the Australian average (human) per capita fish
and seafood consumption of around 11 kilograms.
"Our pets seem to be eating better than their owners."
Wild forage fish, which includes sardines, herrings and anchovies, are an important
link in the marine food chain, as part of the diet of larger fish like tuna and swordfish.
Overfishing of marine resources is a concern to conservationists and the fishing industry.
"While much of the criticism has been on the grounds that forage fish could be better
used for human consumption directly, particularly amongst the poorer nations of the world,
rather than in the production of food for farmed fish, little attention has been paid
to the amount of forage fish used by the pet food industry," Dr Turchini said.
She said she believed the pet food industry was moving towards marketing premium and
super-premium products.
"These gourmet pet foods contain a significant amount of fish that may be suitable
for direct human consumption."
Different raw material, such as by-products of the fish filleting industry, would be
better used in pet food.
A more objective and pragmatic approach to the use of decreasing fish stocks was needed,
she said.

Qld: Residents may be spared total outdoor water ban
South-east Queensland residents may be spared a total ban on outdoor watering .. under
tough level six restrictions expected to come into force later this year.
However .. the state government has vowed to crack down on businesses using too much
water as the drought continues to bite.
Queensland Water Commission chairwoman ELIZABETH NOSWORTHY says the latest water consumption
figures have prompted a re-think on whether watering outdoors with buckets should be banned.
The proportion of the region's water used by residents has dropped from 70 to 66 per cent.
Ms NOSWORTHY says it's a tremendous water-saving effort by residents.
Current level five restrictions are set to be ramped up when the region's dams fall
to 15 per cent capacity .. forecast to occur in September or October this year.

Fire's destroyed part of a primary school in Victoria's east.
Fire crews were called to the Moe South Primary School about 4.30 am .. where the blaze
destroyed a canteen and two portable classrooms .. and two more classrooms were damaged
by smoke.
All four classrooms were for prep children.
An investigation into the cause will get underway today.

KIM BEAZLEY says the federal government needs to stop dithering on the sale of Telstra

The Labor leader says the government should keep Telstra at the level of public ownership
it has now.

MELBOURNE, April 18 AAP - Victorian doctors will meet next month to discuss salaries,
amid warnings they will leave the state in droves unless the government matches other
states' pay and conditions.
Queensland and NSW doctors were paid 50 per cent more than their Victorian counterparts
as a result of government initiatives to attract doctors to work in their public hospitals,
the Australian Medical Association (AMA) Victoria said.
AMA Victoria president Mark Yates today said the Victorian government had admitted
it was already 900 doctors short, and an interstate exodus could leave the public hospital
system unviable.
"As the chasm of conditions and pay increases, because premiers (Peter) Beattie and
(Morris) Iemma value their doctors more, we're going to find it increasingly difficult
to maintain a good public hospital system in Victoria," he said.
Dr Yates said AMA Victoria had submitted a proposal to the state government five months
ago asking for a moderate five per cent pay increase, and a boost in conditions including
involvement in areas such as hospital management, research and teaching.
He said the AMA was very concerned about a future doctor shortage, but it was too early
to consider industrial action.
"We certainly have a meeting of doctors on the fourth of May, because this has been
five months so far," he said.
"But our concern at the moment is truly in the viability of the public hospital system."
Dr Yates said he knew of specialists working part time in the Victorian public system,
of which there were 2,000 working an average of three half-days a week, who were considering
a move to Queensland.
With better pay and conditions, they could be enticed to stay in Victoria and take
on more shifts, he said.
"To do that we have to have a public hospital system that is attractive to doctors,
(and) that will be attractive to doctors from other states so we can recruit them here,"
he said.

files.
A prison officer-turned-whistleblower who applied to see his own file received up to
1,000 files on others with the same surname.
Police said preliminary inquiries indicated a worker at global computer maker IBM,
which was under contract to conduct audits of the police LEAP database, had emailed the
information to the man.
The data included the full name and addresses of some victims of crimes and alleged
offenders, the Herald Sun newspaper reported today.
The breach follows an apology earlier this month from the Office of Police Integrity
head state ombudsman George Brouwer after the OPI mistakenly released confidential police
files on hundreds of people to a single complainant.
In the same week, the personal details of an alleged murderer and his victims were
leaked to the Victorian opposition - printed on the back of other, unrelated documents.
The prison officer had applied for his file because he feared it had been improperly
accessed by police and corrections officials after he raised concerns about a 2000 police
operation to collect DNA from a notorious child killer.
A spokesman for Mr Holding today said the leak should not have happened and the minister
would like a full explanation from Ms Nixon.
"Victorians expect that information stored on LEAP to be secure and not improperly
dealt with," he said.
The police ethical standards department was investigating the circumstances surrounding
the leak, according to a statement from Victoria Police.
"Victoria Police treats any inappropriate release of information - mistaken or otherwise
- extremely seriously," the statement said.

SA: New task force to investigate MP, police paedophile claims
A special police task force has been set up to investigate allegations of paedophilia
against a South Australian MP, a former MP and two police officers.
SA Police Commissioner MAL HYDE says the separate allegations are currently under investigation
by different branches of the police force, but will all be brought together into one investigation.
Mr HYDE says in a statement the special task force takes the current, related investigations
out of the Anti-Corruption Branch and the Sexual Crimes Investigation Branch, so they
can all be dealt with in one area.
Assistant Commissioner BRYAN FAHY will lead the task force, with a team of one primary
investigator and five other officers working under him.

Today, the Bureau of Labor Statistics released the latest unemployment numbers, adding only 18,000 jobs and indicating a rise in the unemployment rate to 9.2%.
"The jobs numbers are an illustration of the need for overarching change in economic policies. The idea supported by Senate Democrats and the President for increased taxes and inflated bailouts does not work. Our government has maxed out its proverbial credit card, and it is time to rein in spending and not inflict tax increases on a weakened economy. Until we reach an agreement to cut spending and get our fiscal house in order, we will continue to see instability in the job market, production and manufacturing, business growth, and more.

"Deficit spending will never be America's answer to reaching economic prosperity. We must restore economic confidence for the private sector to invest and create jobs. Antitrust Agencies Release Annual Reports
On April 1, 2011, the Federal Trade Commission (FTC) and the U.S. Department of Justice's (DOJ) Antitrust Division issued their annual reports. The FTC report describes the Commission's accomplishments during the previous year, including its litigation in the healthcare industry, revisions to the Horizontal Merger Guidelines issued jointly by the FTC and DOJ that provide more clarity and predictability for businesses, its report on privacy issues that proposes a framework for balancing consumer privacy with industry innovation, and its efforts to combat cross-border fraud by using the information-sharing provisions of U.S. SAFE WEB Act of 2006. The DOJ newsletter highlights the Antitrust Division's enforcement actions over the past year, including the filing of 60 criminal cases and obtaining fines in excess of $550 million against corporations and individuals, as well as its competition advocacy initiatives, including its activities relating to the agriculture industry.
Agencies Release Draft Guidance for ACOs
On March 31, 2011, the FTC and DOJ released a joint Proposed Statement of Antitrust Enforcement Policy governing accountable care organizations (ACOs) under the Patient Protection and Affordable Care Act. The Affordable Care Act contemplates that ACOs - networks of healthcare providers sharing responsibility for patients - would manage the healthcare needs of Medicare beneficiaries and, potentially, those of commercially insured patients.
The agencies' recent guidance addresses the antirust implications of competing providers collaborating within an ACO by, among other things, applying a rule of reason analysis to activity by qualifying ACOs, establishing an antitrust "safety zone" for ACOs with a combined share of 30% or less of each common service within the primary service area, and providing guidance concerning agency review of ACOs that fall outside the safety zone. SEC Charges Brokerage Executives for Failing to Protect Confidential Customer Information
On April 7, 2011, the Securities and Exchange Commission (SEC) charged three former brokerage executives with failing to protect confidential information about their customers. According to the SEC, the executives improperly transferred customer records to another firm during the winding down of their company's business operations. The record transfer violated Regulation S-P of the Securities Exchange Act (the Safeguard Rule) because the customers were not notified in advance and given reasonable time to opt out. This marks the first time the SEC has assessed financial penalties against individuals charged solely with violations of Regulation S-P.
Ban on Online Distributor Sales Not Permitted in EU
An advocate general (adviser) to the European Court of Justice recently opined that an absolute ban on Internet sales by a distributor will usually be an automatic infringement of EU competition law. Though this opinion was given in the context of selective distribution agreements, the same principle would apply to such a restriction included in other types of vertical (supplier/purchaser) agreements, such as exclusive distribution agreements. Pro-government crowds swarmed outside the battered home of an Iranian opposition leader Friday after militiamen attacked with firebombs and beat a bodyguard unconscious in a brazen message of intimidation .
The assault on Mahdi Karroubi's five-story residence late Thursday - just hours before major state-backed rallies - displayed the growing tactics of trying to isolate and harass top opposition figures after relentless crackdowns appear to have driven protesters from the streets.
Karroubi, 72, a cleric and former parliament speaker, has been the most public protest leader in recent months - and has paid the price with repeated damage to his car and tense confrontations with backers of the Islamic state. But the latest backlash, described by a pro-reform website, was by far the most aggressive.
Mobs of militiamen - known as Basij - began breaking down the front door of Karroubi's residence before being driven back by warning shots from guards, according to the Sahamnews website, which supports Iran's pro-reform movement.

Hossein Karroubi said dozens of hard-liners continued to damage the opposition leader's home Friday and that police were not responding to the scene. Some security cameras outside the building were torn down, he said.
